Sally McNeil Charges And Conviction

After McNeil’s persistent appeals on multiple grounds and juror instruction, the US 9th Circuit Court of Appeals overturned his conviction. The State of California reacted by appealing to the Supreme Court, which in turn reversed the 9th Circuit’s ruling. As a result, the case was sent back to be handled again by the 9th Circuit Court.

On March 29, 2005, the 9th Circuit issued an opinion ruling in favor of the State and reinstating McNeil’s original conviction. The court relied on information and instructions from the SCOTUS opinion when making their decision.

McNeil earned the rank of sergeant while serving in the United States Marine Corps at Camp Pendleton. Furthermore, she became a two-time winner of the U.S. Armed Services Physique Championship in the late 1980s.
